A federal appeals court has ruled against the BMWED in our attempt to require BNSF to perform full visual human-conducted track inspections at the bare minimum requirement of FRA standards. Judges from the U.S. Court of Appeals for the D.C. Circuit denied our petition against the FRA, allowing for BNSF to curtail physical track inspection to twice monthly in order to test new unmanned inspection technology.

As many of you sadly know, we lost a Brother last week in a tragic work truck accident. Keith Whited, 40, of Castlewood, Va., was killed Sept. 25 following a traffic collision involving his Norfolk Southern fuel truck. Brother Keith had been employed with N.S. for 10 years and was a member of Affiliated System Federation Local Lodge 571.

Effective October 1, Nevada law regarding a driver's responsibility at railroad crossings is changing. While current law requires drivers to yield to trains, a change will also require drivers to yield to on-track equipment.
